On November 30th, Israel will join the US Visa Waiver Program (VWP), which will allow entry to the U.S. without a visa. How will this work? What do you have to do before you travel? Here are 10 of your most frequently asked questions :
- Does a Visa Waiver mean that I can just show up at the US port of entry with my Israeli passport?
Not exactly. Israeli citizens need to qualify under the Electronic System for Travel Authorization system (ESTA) prior to their travel. It is not enough that you hold an Israeli passport, you need to obtain authorization prior to your flight to the U.S.
- What exactly is ESTA
ESTA is an electronic system where you may apply for authorization to travel to the US without first obtaining a visa at a U.S. consular post.
- How do I apply under ESTA?
The application process is done online at https://esta.cbp.dhs.gov/ and requires payment of a fee of $21 per person. Applicants may also download the “ESTA Mobile” app through the app stores.
- If I have a B visa, should I apply for ESTA?
You do not need to have both a B visa and an approved ESTA. One form of entry is not “better” than another. Entry to the U.S. under ESTA is allowed for the same purposes and under the same rules of a B-1/B-2 visa – it does not provide work authorization.
- How does ESTA differ from a B visa?
Under ESTA, entry is limited to a maximum of 90 days (B Visa– entry if up to six months). You can’t enter the U.S. on ESTA and request to stay longer or to be allowed to study or work.
- Is ESTA available to all Israelis?
No. This is the critical difference between the two programs. You cannot apply for the visa waiver program if any of the following have occurred at any time:
- criminal record
- past immigration violations
- travel to or are dual nationals of certain terrorist countries
- denial of a B visa application
Note: Once you receive an ESTA denied, you cannot make another ESTA application in the future.
- Do I need to apply for ESTA every time I travel to the US?
No. ESTA authorization is valid for two years unless there is a material change in your personal circumstances.
- How long in advance of my travel do I need to apply for ESTA?
ESTA authorization is given up to 72 hours after filing.
- What do I do if the ESTA is denied?
Please contact us immediately rather than attempt another ESTA application. We will need to understand the reason for the denial. A refusal does not always mean you may not travel to the U.S. Often, we will advise you to apply for a visa, but in some circumstances, applying for a visa would not be sufficient, and we will need to take certain preliminary actions prior to filing.
- Can I work in the US under ESTA?
The entry on ESTA does not allow you to work in the US! Today, more than ever, enforcement regarding illegal work is a top priority for the immigration authorities. There are quite a few cases in which enforcement agencies make surprise visits to various workplaces. There are severe consequences for illegal work in the U.S.!
